1. Agreement to Terms

Welcome to Plannr. These Terms of Service ("Terms") govern your access to and use of the Plannr platform, including our website, applications, and services (collectively, the "Service").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Plannr is operated by Plannr Pty Ltd ("Plannr", "we", "our", or "us"), an Australian company.

2. Eligibility

To use Plannr, you must:

  • Be at least 18 years of age
  • Be a resident of Australia (or other supported regions as we expand)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

3. Account Registration

To access certain features, you must create an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

Plannr is a financial planning platform that helps you:

  • Connect and aggregate financial accounts via Open Banking
  • Track income, expenses, and transactions
  • Create and manage budgets
  • Set and track financial goals
  • Monitor investments and net worth
  • Receive AI-powered insights and categorization
  • Collaborate with family members or advisors

5. Open Banking and Data Access

When you connect your financial accounts through Open Banking:

  • You authorize us to access your account information through our accredited data recipient partner (Basiq)
  • Access is read-only - we cannot move money or make changes to your accounts
  • You can revoke access at any time through your Plannr settings or directly with your financial institution
  • Data is accessed in accordance with the Consumer Data Right (CDR) framework

You represent that you have the authority to connect any accounts you link to Plannr and that doing so does not violate any agreement with your financial institution.

6. Subscription and Payments

6.1 Subscription Plans

Plannr offers various subscription tiers with different features and limits. Details of current plans and pricing are available on our website.

6.2 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • You authorize us to charge your payment method for the applicable fees
  • All fees are in Australian dollars unless otherwise stated
  • Fees are non-refundable except as required by Australian Consumer Law

6.3 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

6.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will apply at your next renewal date after the notice period.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Access or attempt to access accounts that are not yours
  • Share your account credentials with others
  • Interfere with or disrupt the Service or servers
  • Attempt to reverse engineer, decompile, or hack the Service
  • Use automated systems (bots, scrapers) to access the Service
  • Transmit malware, viruses, or harmful code
  • Harass, abuse, or harm others through the Service
  • Impersonate any person or entity
  • Use the Service for money laundering or fraudulent purposes
  • Circumvent any access controls or usage limits

8. Intellectual Property

8.1 Our Property

The Service, including all content, features, and functionality (including but not limited to software, text, graphics, logos, and designs), is owned by Plannr and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 Your Data

You retain ownership of your financial data. By using the Service, you grant us a limited license to use, process, and display your data solely to provide the Service to you.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

10.1 No Financial Advice

Plannr is not a financial advisor, tax advisor, or investment advisor. The Service provides tools and information to help you manage your finances, but does not constitute professional financial advice. We recommend consulting qualified professionals for specific financial decisions.

10.2 Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law.

10.3 Data Accuracy

While we strive for accuracy, we cannot guarantee that all data from financial institutions or AI-generated categorizations will be error-free. You should verify important information independently.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

  • Plannr shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
  • We are not liable for decisions you make based on information from the Service
  • We are not liable for actions or omissions of third parties, including financial institutions

These limitations do not affect your statutory rights under Australian Consumer Law that cannot be excluded.

12. Indemnification

You agree to indemnify and hold harmless Plannr, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

13.1 By You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, you will lose access to your data and any unused subscription time.

13.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees
  • Create risk or possible legal exposure for us

We will provide reasonable notice before termination where possible, except in cases of serious violations.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, subject to any legal retention requirements.

14. Dispute Resolution

If you have a dispute with us:

  • Contact Us First: Please contact us at hello@plannr.com to attempt to resolve the issue informally
  • Mediation: If we cannot resolve the dispute informally, we agree to attempt mediation before litigation
  • Governing Law: These Terms are governed by the laws of Victoria, Australia
  • Jurisdiction: Any legal proceedings shall be conducted in the courts of Victoria, Australia

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Plannr
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations freely
  • Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control
